Q & A Family Law Prosecutor’s Office

When should I consult a divorce lawyer?

It was never too early in the process of consulting with a lawyer. Engaging with earlier legal counsel allows you to make decisions based on information and avoid potential traps – increase your ability to achieve your goals. Remember, consulting a Austin divorce lawyer does not mean that you will divorce; You may need information about the legal process of family law. The general problem I see is a client waiting too long to contact a lawyer to get legal advice and can end with better results if they have been told about their previous options.

What should I bring to the initial consultation?

Because family law problems can be very stressful, it is a good idea to write the questions you have and take them to the first meeting so that there is nothing important forgotten. You may also want to carry documents that are relevant to your case if available – such as federal income tax returns, or documents on your assets and debts. If you sign a pre-marriage agreement or other type of property agreement before or during your marriage, bring a copy to the consultation.

I just served with divorce paper. What should I do?

You must maintain a divorce lawyer as soon as possible so they can provide legal advice on what has been requested and every audience that has been scheduled. Once maintained, your divorce lawyer will apply for your behalf.

My partner and I just want to hire one lawyer for our divorce. Is that possible?

In Texas, one lawyer may not represent the two couples. It is also impossible for a divorce lawyer who is maintained by one partner giving legal advice to the opposing party. Do some research to find out whether your country allows representatives by one lawyer.

I understand that I have to go through mediation for my divorce. Is it true?

In Travis, Williamson and Hays, mediation is needed before the final hearing will be held in the case of family law. In mediation, a trained third party, neutral acts as a facilitator for discussion of settlement between the parties and their respective lawyers. If an agreement cannot be contacted during the mediation process, the parties can decide to resolve their problems through litigation.

How long does it take to divorce?

The time needed to develop the final provisions of your divorce is highly dependent on the number of problems that must be resolved and the willingness of both parties to reach an agreement. In Texas, there is a waiting period based on the Law 60 days after the petition is submitted before the divorce can be resolved.

Does the two pairs have to approve divorce? What if one of us doesn’t want to divorce?

Texas has a divorce statue “without error”. This means that divorce can be obtained, even if only one partner wants it. You don’t need your partner’s approval to apply for the original for divorce or to pursue divorce.

What does it mean when a lawyer is certified in family law by the Texas Law Specialization Board?

Family law attorneys who want to certify the council in family law by the Texas Legal Specialization Board apply to the Texas Legal Specialization Board to take written examinations for a day to become a certified council in family law. Of the 78,032 lawyers licensed to practice the law in Texas, only 691 was certified by the Board in the Family Act by the Texas Law Specialization Board, or less than one percent of the lawyer in the state of Texas.

* In addition to taking a written certification exam, family law attorneys that apply for Council Certification in family law must have shown extensive expertise in things such as divorce, property division, child prisoners, child support, other paternity and matrimonial problems.
